A judge who dismissed thirty-seven out of sixty-one indictments pending against two defendants, with the understanding that the Commonwealth might seek new indictments on other evidence, acted properly within his discretion, where the information before him suggested that a number of the indictments had been obtained on the basis of false testimony by the police detective who had been the sole witness before the grand jury, and where the Commonwealth, despite its efforts in good faith to do so, had been unable to provide further information required by the judge.
